Eligibility
You must be at least 18 years old to use our Services. By using the Services, you represent that you have the legal capacity to enter into this agreement.
Services Overview
Our directory connects users with service providers/vendors in the nonprofit fundraising industry. Some services require payment and may involve the collection and processing of PCI data. We may add, modify, or discontinue features at any time without prior notice.
PCI Data & Payment Processing
We comply with the Payment Card Industry Data Security Standard (PCI DSS) in the collection, storage, processing, and transmission of credit card information. All payment transactions are processed through a PCI-compliant payment gateway provider. We do not store full credit card numbers or CVV codes on our servers. You agree not to use the Services to process payment information in any way that violates PCI DSS or applicable law.
User Accounts
You are responsible for safeguarding your account credentials. You must notify us immediately of any unauthorized use of your account.
Acceptable Use
You agree not to use the Services for unlawful or fraudulent purposes, attempt to gain unauthorized access to any systems or networks, or submit false, misleading, or harmful information.
Directory Listings & Content
Vendors are solely responsible for the accuracy and legality of their listings. We reserve the right to edit, remove, or reject any listing at our discretion.
Fees & Payment
All fees are disclosed prior to purchase and are non-refundable except as required by law. Prices and payment terms may change with prior notice. By submitting payment details, you authorize us (and our payment processor) to charge your payment method for agreed amounts.
Data Security
We implement reasonable technical and organizational safeguards to protect your information. While we follow PCI DSS requirements, no system is 100% secure. You use the Services at your own risk.
Privacy
Our collection, use, and disclosure of personal and payment data is governed by our Privacy Policy. By using our Services, you consent to such data practices.
Disclaimers
We provide the Services ‘as is’ without warranties of any kind. We are not responsible for the accuracy of vendor listings or for transactions between users and vendors.
Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability will not exceed the amount paid by you for the Services in the 12 months prior to the claim.
Indemnification
You agree to indemnify and hold harmless Fundraising Talent Pool from claims, damages, or expenses arising out of your use of the Services or violation of these Terms.
Termination
We may suspend or terminate your access if you violate these Terms or applicable laws. Upon termination, your right to use the Services ceases immediately.
Governing Law
These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict of laws principles.
Changes to Terms
We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance.
